The Government has issued the final version of the Employment Equality (Age) Regulations 2006, which are set to come into force on 1 October 2006.
On the 1 October 2006 the Age Discrimination Regulations ("the Regulations") came into force. These have been designed to protect both young and old from being discriminated against by virtue of their age in the workplace.
Claims brought against you could be expensive to defend and very time consuming. You are unlikely to recover your legal fees in the tribunal even if you win and hearings tend to last for several days, if not weeks.
Compensation for discrimination-based claims does not have any financial cap and is usually based on the individual’s loss of opportunity to earn a salary for a period of time. A further sting in the tail is an associated award that can be made for "injury to feelings" and this can be anything up to £25,000 in addition to loss of earnings.
The Regulations apply not only to recruitment but also to existing employees of any age and those nearing retirement. They are grafted onto any array of existing anti-discrimination legislation there to protect employees on the grounds of their sex, race, disability and sexual orientation.
