Mediation

The impartial third person

Mediation is a process that has become increasingly popular in recent years. It is used by a growing number of splitting couples that wish to deal with the issues connected with the ending of their relationship in a less acrimonious way, in particular where children are involved. However, mediation is a process that is frequently misunderstood.

Informed decisions

Essentially, mediation can be described as a process in which an impartial third person assists the parties with their negotiations and helps them to reach their own agreed and informed decisions. The aim of mediation is not to reconcile you with your partner or to help you to emotionally come to terms with the end of your relationship. Mediation is a very pragmatic approach to deal with issues like children and finances.

Communicating

Sorting out these issues through court proceedings often has the negative effect of worsening the relationship of the parties and of being very expensive. However, especially where children are involved, you will have to deal with your former partner in the future. Mediation might help you to get communications going again.

Legal position

Opting for mediation does not mean to disregard your legal rights. The mediator will keep you informed about legal positions. Should you reach an agreement you and your former partner will both seek independent legal advice from a solicitor to discuss the outcome and its consequences for you.

Mediation is not always suitable. However, you should regard it as one possible way to deal with your differences.
