A new direction
In November 2005 the Commission for Racial Equality (CRE) published its new statutory code of practice on racial equality in employment.
This new code took effect on 6 April 2006 and replaces the CRE’s original code of practice (the Code of Practice for the Elimination of Racial Discrimination and the Promotion of Equality of Opportunity 1984).
The code contains recommendations and practical guidance on how to prevent unlawful racial discrimination and achieve equality of opportunity in employment. The new code reflects the law contained in the Race Relations Act 1976 and contains many useful references to real cases and examples.
Although the code does not impose legal obligations, it does help to outline an employer’s obligations under the RRA and importantly, from 6 April 2006, will now be used as evidence in tribunal proceedings brought on or after that date under the RRA. Courts and tribunals will be under an obligation to take relevant parts of the code into account when deciding cases, so it is essential reading for those involved in equal opportunities.
The Code’s key recommendation for employers is to draw up an equal opportunities policy and to have a strategy to put this into practice.
